A SETTLEMENT between two millionaire brothers over $100 million after years of litigation might never be known by the public after the appellate court ordered that the agreement be sealed yesterday.
Both legal teams representing Rami Weisfisch and Amir Weissfisch, petitioned Justices Christopher Blackman, Stanley John and Abdulai Conteh to have a confidentiality clause enforced. The request was granted.
In what is considered to be an ending to the disagreement, Justice Blackman thanked both sides for bringing the six-year matter to a resolution. They also agreed upon a statement which is to be released to the public on behalf of both brothers.
Before the matter was adjourned, Rami Weisfisch’s lawyer Krystal Rolle, asked that the final settlement be removed from court records as it was not intended for the document to have been committed. She said there were still several small matters, including the consolidation of a few Supreme Court matters.
However, Justice Blackman questioned whether or not it could be allowed.
The Israeli brothers have for six years been engaged in a legal battle over $100 million.
They were joint owners of one of the most prominent metal trading firms in London – Metals Resources Group (MRG).
Mr Rami Weisfisch (the brothers spell their surname differently) ran MRG, which became a dominant force in the global cobalt market in 1999 and closed in 2002.
His brother Amir was his partner. Amir took legal action in England in 2006, claiming that Rami refused to account to him for their partnership profits over an eight-year period.
Since that time, claims and counter-claims have been exchanged between the parties.
