A JUDGE has scheduled a hearing for arguments over a procedural dispute concerning the case of a man charged with setting fire to a dormitory at the Bahamas Agriculture and Marine Sciences Institute (BAMSI).

Dave Dion Moxey, of Fresh Creek, Andros, appeared before Justice Bernard Turner on Friday for a status hearing concerning the January 15 incident, when flames ravaged the dormitory at the institute.

Preliminary reports from police said it was the result of arson and that the blaze began in the roof around 7pm. Officials battled the blaze and managed to extinguish it shortly after 11pm; however, it left one of the male dormitories at the institute severely damaged.

Moxey was arraigned a month later in Magistrates Court.

In Friday’s Supreme Court proceeding, Moxey’s lawyer, Calvin Seymour, informed the judge that his client’s Voluntary Bill of Indictment (VBI) contained nothing that connected his client to the blaze.

Crown respondent Linda Evans said that there were two statements that were part of the original indictment. However, neither Mr Seymour nor the court was aware of the statements.

Mr Seymour said it was not appropriate to produce the statements at this stage to attach to the original VBI for which he is facing trial in Supreme Court.

The judge said he would hear full submissions from Crown and defence counsel on the matter on June 3.

The VBI is a bundle of documents containing the Crown’s case against Moxey and facilitated the transfer of the case from the Magistrate’s Court to the Supreme Court.
