I can't see how Chapter 11 could be dismissed as CCA desire with this proposed plan in place.
What is more worrying is that the current downgrade is on the premise that Baha Mar will be open in the near future - something that is categorically not possible if the Government continues downs its poorly chosen path of supporting CCA and trying to wind the Company up.
If the winding up petition continues and is approved, we are almost guaranteed to get a further credit downgrade to junk status - at which point the cost of Government borrowing (as well as consumer and business borrowing) will rise significantly, along with our country's deficit.
CCA asked Christie to pressure Sarkis to accept the Chinese offer on their terms, by requiring Sarkis to put in an extra $100m + guaranteeing another $200m. So they filed the winding up order thinking it would create too much pressure for Sarkis not too accept.
Of course, it didn't go to plan (does it ever for the PLP?) and on the same day as the Government's lawyers are arguing for the appointment of 'provisional' liquidators and not a winding up order (changing the goal posts), Rosewood pulls out, citing lack of supreme court approval and Baha Mar no owning the land. The second point was also a PLP decision as the AG filed a request to reclaim the land.
Not only that, but now it is clear that the US judge will order CCA to release communications with the Government which will demonstrate more collusion to the world.
So now the PLP are back-pedalling via Obie. I expect to see a concession from the Chinese soon on the requirements of the guarantee. If Christie does not have enough pull with the Chinese to execute this, both his and the Bahamian people's fate is sealed. Baha Mar will be in court battles for the next 3 years, while the buildings and the economy decays.
It was sadly inevitable when the PLP stopped chapter 11 being recognised by the supreme court and prevented the debtor in possession financing being approved, as well as failing to pay foreign workers.
It doesn't matter if the building is complete, the Government's and the Chinese will have control of an empty shell, with no one willing to operate the hotels.
It was so obvious this would happen, yet they persisted to follow their own selfish and ego driven agenda. Shame on you Christie and you're gang of hacks. You have failed this country.

While it is good that there is the prospect that someone will be prosecuted for corruption, Gomez looks like he is going after the FNM only.
We need an independent body who can chase prosecutions regardless of what party they are members of.
