He is basically saying "I don't want to make a decision, so I will deny Chapter 11 be recognised and I will leave this up to the Government to pass legislation.".
That is not how supreme courts are meant to work - they should come to a decision using existing legislation, which is no doubt why he granted leave for Baha Mar to appeal the ruling.
Whatever happens, it's clear that if we continue this route, the only ones who will win are the lawyers - there will be many, many losers.

If Chapter 11 had been approved, everyone would have been paid, CCA would have been out and Bahamian's would currently be working on finishing the development.
The Foreign Minister wants to talk about evicting someone who has invested 13 years and $900m into the Bahamas, because he disagrees with the Christie's attempt to nationalise Baha Mar? Can he explain how Sarkis is not acting "in the public interest". What he means is he is not acting in the PLP's interest.
Apparently expatriates should also be sent home as “They criticise the politics of the country."
The leader of the free world, President Obama, is criticized constantly, but somehow Christie is above criticism to the extent someone is threatened with deportation?
Apparently “money does not buy our silence and our subservience.”, unless it comes from the Chinese I guess. I haven't heard a single PLP minister complain about CCA, the sole reason why the resort is not open.
What a ridiculous situation. Sarkis was willing to put another $70m in to the development to make sure everyone got paid, but the PLP intervened and prevented this so 'employees could not be used as pawns'.
Then they decide to not pay the expats, resulting in one of the brands leaving - the others will no doubt soon follow. By the time we get to the 19th August liquidation hearings, there will be nothing but a shell left to liquidate - all the operating contracts will have disappeared and it will take another 2 years to find new operators.
Well done Christie, you and your team of incompetents have single handedly destroyed any chance of Baha Mar opening in the near term and no doubt dissuaded any foreigner from making a substantial investment in the Bahamas for the next decade.
This is ridiculous. Baha Mar offered to put in $200m and asked for ExIm to put in $200m and now ExiM want Baha Mar to guarantee their half? They may has well just put in $400m themselves. For the Government to claim that this is reasonable request and then blame Baha Mar not agreeing to it demonstrates just how uncommercial the Government is.
That is certainly what it looks like. The FNM have an opportunity to push for this, but they too have been silent, allowing Christie to get away with his silence. Terrible representation for this country.
Why hasn't the Govenment responded to Baha Mar's offer if putting in another $200m and ousting CCA, replacing them with Bahamian contractors. If they supported this, they could easily push CCA and China ExIm do do a deal in the same way they have been pushing Baha Mar.
Sakis' move to put another $200m into the project and higher Bahamians to replace CCA was clever. It has worked and CCA are trying to stay in the PR game with this potential offer.
They know that even Christie cannot turn down the offer to hire Bahamians.
