This Woman should resign out of respect for the Bahamian People if the Environment is truly Carnival’s first and foremost priority … but she won’t as Carnival is the “worst of the worst”, so instead our Penalty should be settlement of our National Debt, failing which a complete Ban of ALL Carnival “Group” (ie. all Brands) Ships from our territorial waters … something tells me we might finally be debt free!
This Case is a bizarre and confusing mess … and dare say this most peculiar judicial reasoning helps. There is no question that Common Areas that should have been handed over to POA and now ordered, should be. However, Damages for the Beach Reserve is inappropriate, as they can never be calculated to properly compensate Home Owners for the lack of Beach Access “forever” more! With respect to the proposed Marina, this is tricky, as if approved, it would indeed appear as if the Judge is inserting herself into such process, but yet states “… the Court has not set aside planning approval - and cannot do so”. Such reasoning is illogical and contradictory. As for 8 years … 18 months to render a Judgement … but yet circulating in “draft” prior?!? … this is obviously reprehensible and can not be excused, much less equated to “discretion”, but rather must be addressed if our Judiciary is to be taken seriously.
Arresting these Vessels could well entail I’ll thought out Legal Advice, as if the Cruise Owning Parent is bust, there could well be no money forthcoming, unless the Banks that hold First Priority Mortgages agree to pay off debts to protect their security, but why do this if you are a secured priority lender and risk not being able to recoup?!?
Hope the Law Firm gave proper advice and acted on clear instructions based thereon, as the $2.1mil. debt could pale in comparison to the Costs of funding these Arrests until release and could well serve as Legal Precedent in the Shipping World as to “what NOT to do”!
This is a matter of Public Trust … release the Body Cam Footage to the Public to enable them to draw their own conclusions … as is done elsewhere in World.
