Hats off to Fred Smith. If I ever need a lawyer, I will definitely look him up. Could anyone name another lawyer in The Bahamas as passionate about the causes he has champion over the years. The guy is tenacious.
There is an expectation of sex once a person get married. The expectation is actually enshrine in law that sex (consummation) is part of the marriage been sealed. In fact, in some countries if a would be husband learn on his marital bed that someone else consummate before he did the marriage is null and void. With that been said marriage creates a right to sex by either party. I am sensitive to the fact that abuse could exist in a marriage. There are adequate assault laws to remedy such occurrences.
Say what you may about Fred Smith. You can't say he owes his allegiance to any political party. He makes quite a bit of moneys from the stupidity of public servants. His wins includes, beating up the Custom Department with regards to the Hawkes Bill Creek Agreement; police, prison as it relates to unlawful detention. The environment is a bonanza for him. His detractors claim that his concern is only Haitians but turn a blind eye to the fact that he is a champion for the environment.
Law 101. Everyone have the right to have their day in court and face their accuser. Immigration can be sued but the court can't even if they got it wrong. The courts are there to prevent immigration from deporting legal residents.
If that's the case, wouldn't the same logic apply to Nassau considering the city dump is always burning with the same agents mentioned above. Imagine quarantining the entire island.
The judgement is not as precedent setting as many of you may think. What do you suppose happens when a 19 year old and older applies for citizenship. Guess what, he or she receives it as though they were eighteen. The precedent has been set from July 11, 1992. In case you are wondering the significance of that date. It is 19 years after independence when the government first had to make a decision on what to do with persons who applied after the statutory time period. That is the date that Emac and others should have made their ignorance known.
