The Judge ruled correctly in this case. It was the Hon. QC has been saying all along. Immigration does not have the authority to round up a suspected illegal person and ship him/her out of the country without bringing that individual before the Courts. Only the Court of law can order a deportation. If all of you non-lawyers would remove your emotional lenses when it comes to the Haitian community, you will see that this is a no-brainer.
Members of the RBPF are known to fabricate explanations, plant drugs on innocent suspects, and, in some cases, even kill innocent people. So, I don't believe it is "ghetto" to have a bit of suspicion about their actions.
This is a very sad story, and an even more sad indictment against the Immigration, and the Bahamas Government. I cannot believe that we find it so difficult to set aside our emotions and deal with this community in manner consistent with the laws, human rights conventions established by the United Nation, and basic human decency. Of course we must do a better job of enforcing our borders, detecting and expelling those who are in the country illegally. However, we cannot trash our constitution as we trample on the human rights of those who were born in this country.
A marital rape case would be investigated like any other rape case. The victim makes a complaint to the Police, and the police investigates. Based upon their findings, the police brings a criminal complaint against the accused, who is then charged before a Magistrate/Judge. At trial, the evidence is presented, and a Judge/Jury will determine if the accused is guilty or innocence. It happens in the courts every day.
Ignorance is really a terrible thing, and should be a sin in this day and time when knowledge is only a google away.
It will be monitored and prosecuted in the same manner it is done in over 50 Countries that have enacted such laws. Most states in the U.S. have such laws on their books. England, since 1991, France, Germany, Australia, South Korea, Sweden, Belgium, Norway, Sweden, just to name a few. Even Nepal has successfully prosecuted husband rapist. So, why can't it be done in the Bahamas? Why do we always have to lag behind the rest of the civilized world in everything?
